Chapter I. Overview and Purpose of the Document

We, S.C. NEURO ENHANCEMENT S.R.L., are the owners of the www.veruvis.com platform.

S.C. NEURO ENHANCEMENT (”Veruvis”) is a company that offers cognitive training services assisted by neural mapping engineering technologies through electronic interfaces, generically called Brain Map – Brain Computer Interface BM-BCI.

Brain Mapping – Brain Computer Interface (BM-BCI) is a relatively new and emerging cognitive training modality conducted through computer-assisted technologies. These technologies and practices have broad applicability, including in the learning sciences, computer games, artificial intelligence, medicine, transportation, industry, professional services, and other civilian and military fields. The principles underlying BM-BCI technologies are interdisciplinary, and involve specialists from diverse fields, including neuroscience, electronic engineering, psychology and behavioural sciences, medicine, programming and artificial intelligence, and personal development. Essentially, BM-BCI technology facilitates communication between the functioning of the human brain and various electronic devices in a non-invasive manner to facilitate various processes, which may vary depending on the needs for which it is used.

It has proven to be a real success in cases of cognitive performance enhancement for all ages, for the recovery of lost or impaired functions of patients with various neuro-motor disorders, autism, post-traumatic stress, degenerative diseases (Alzheimer’s or dementia) as well as for the development of new devices based on mental commands.  For example, in the field of aviation, pilots’ orientation and commands are also based on BM-BCI technologies.

The purpose of these general conditions is to define the terms and conditions for the provision and use of the Veruvis.com site, hereinafter referred to as the ‘Site/Website’.

By using this site, you acknowledge that you have read these terms and accepted them. If you do not agree to the terms and conditions set out in full, please do not access our services.

Any new feature or option that will be added to our platform will also be subject to these terms and conditions. You can read the latest version of our terms and conditions on this page. We reserve the right to update, change or replace any part or detail of our terms and conditions by informing you of the changes through the communication channels available on our online platform. It is your responsibility to check this page periodically to verify the changes.

Chapter II. Definitions

In this document, the following terms will refer to the following:

VeruvisVeruvis, which owns and manages any web page under the Veruvis umbrella, hereinafter referred to as “the Company”.
Veruvis website/ PlatformAny web page owned, managed or under the umbrella of Veruvis SRL.
UserMeans the natural person who accesses the Platform.
ServiceRepresents a service (otherwise known as an advantage) offered by the company to the user – i.e. the availability of the website, the possibility to contact the company etc.
SubmissionSharing personal data of the User through the Online Platform, for example by filling in a contact form (sharing e-mail address, name, surname, telephone number).
Third PartyThe natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
ClientThe natural or legal person who has ordered one of the services offered by Veruvis, following a request sent via the website or communicated by e-mail.
LinkRefers to a keyword or address of a site outside or inside the Site that upon clicking on it initiates a visit to a new web page.

Chapter III. Modification of Terms and Conditions

Veruvis reserves the right to modify, add, terminate these Terms at any time by posting the amended Terms in the “Terms and Conditions” section of the website. Users have the obligation to permanently check the “Terms and Conditions” section to ensure that they are aware of the update or modification of the conditions.

Unless expressly stated otherwise, the amendment to the Terms is immediately applicable. If the website is still used, the User’s acceptance will be considered as tacitly manifested.

Chapter IV. Intellectual Property Rights

The content of the Veruvis.com website: images, texts, web graphics, scripts, software, design rights, model rights, patents, trademarks are wholly owned by Veruvis and are protected by the Copyright and related Rights Act and the Intellectual and Industrial property laws. The use of any of the items listed above without the agreement of Veruvis is punishable, in accordance with the laws in force.

The Platform Administrator may grant the User, by agreement, the right to use in a described form, a certain content of the site. This agreement applies strictly to the defined content / contents, for a period established in the agreement and only to the person (s) who have been allowed to use these contents, without being able to use other contents of the Platform.

The use on the Platform of any trademark name does not constitute an advertisement for the respective company. The administrator of the Platform does not assume responsibility and cannot be blamed for damages caused by using the content of the site.

For notifications, please report any copyright infringement reported on dpo@veruvis.com.

Chapter V. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Veruvis website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

  1. modify or copy the materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on Veruvis website;
  4. remove any copyright or other proprietary notations from the materials; or
  5. transfer the materials to another person or “mirror” the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Veruvis at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Chapter VI. Disclaimer

The materials on Veruvis.com website are provided on an ‘as is’ basis. Veruvis makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Veruvis does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

Chapter VII. General Conditions

By accepting the Terms and Conditions presented on this page, it is understood that you are of minimum age according to Romanian laws and you consent to the use of our site by your minors. We reserve the right to refuse to provide services to anyone for any reason at any time.

Chapter VIII. Processing of personal data

By contacting us by any means (contact form, email, telephone, social media, etc.), by filling in your data in the forms on our website, you understand that your personal data will be included in our database and that they will be processed under the electronic contract between the parties (Terms and Conditions), in order to be able to respond to your requests, to provide you with the requested technical assistance but also to improve our products and services. You may not use false email addresses / social media accounts, claiming to be someone other than who you are, or attempting to mislead Veruvis as to the origin of any comments. You are directly responsible for any comments / reviews published and for the accuracy of the information published. Veruvis is not responsible and will not be liable for any comments posted by you or any third party.

We have ensured that both our employees, who are authorized to process personal data, have undertaken to maintain the confidentiality of data in accordance with the provisions of the GDPR, for the duration of their employment and after termination of employment.

Chapter IX. Use of cookies

The Veruvis website uses cookies. Cookies represent data stored on the User’s hard drive, containing information about the User. The use of the cookie mechanism represents an advantage for the benefit of the Users. To find out the list of cookies used by our site, please access the Cookies Policy.

Chapter X. Data Security

Veruvis adopts all the security measures to protect the personal information of the Users of its online platform. By using the functionalities of the platforms or by contacting us, the User assumes responsibility for the information transmitted.

When transmitting personal data to us, through the forms on the site, the information will be protected both offline and online. All information about Users is confidential. Only employees whose specific activity involves the processing of personal information (for example, customer support service representatives) have access to the identification data of Users. The servers on which the personal identification information of the Users are stored are located in a secure location.

Chapter XI. Disclaimer of liability

The information included on the Veruvis website is informative and is made available in good faith from sources which Veruvis considers to be reliable. If any information falls under the copyright and related rights law, the user is asked to make this known to the owner at the email address dpo@veruvis.com, so that the necessary legal measures can be taken.

The Company reserves the right to change any information displayed on the Site as a result of technical errors or which, due to technical errors, presents erroneous or derisory information for the use of the Site (information that any user with an average level of training may consider to be erroneous/derisory).

The Company is not liable for any damage caused by improper use of this Site information. We are not liable for any malfunctions, viruses, damage caused by system errors, as a result of accessing our page.

With all that is mentioned in this chapter, we promise that we will do our best to keep the information provided up to date and of interest.

Veruvis.com website may contain links to sites operated by third parties (“Third Party Sites”). These links are intended to provide additional information only. The inclusion in the Veruvis website of any link to a Third Party Site does not imply that we approve, endorse or accept responsibility for this Third Party Site, its content or use, or use of the services provided through it.

We are not obligated to filter and monitor and have not investigated or monitored any Third Party Site for accuracy, completeness or compliance with applicable law. We are not responsible for any damage or loss caused by your use of the Veruvis website or your reliance on such Third Party Sites.

Use these Third Party Sites at your own risk. We suggest that you carefully review the policies and practices of these third party sites and ensure that you understand the sites before engaging in any action or transaction. Complaints, claims or claims, concerns or questions regarding products and services of third-party sites should be directed and / or redirected to them.

Chapter XIV. Prohibited uses of the site

In addition to the prohibitions already mentioned in the Terms and Conditions, you are not authorized to use the Veruvis website or its content for the following:

  1. any illegal action;
  2. to ask other persons to initiate or participate in illegal actions;
  3. violate international, federal, local laws, rules, general laws or other local ordinances;
  4. violate or disregard our intellectual property rights or those of others;
  5. harass, abuse, insult, hurt, defame, slander, denigrate, intimidate or discriminate on the basis of sex, sexual orientation, religion, ethnicity, race, age, nationality or disability;
  6. to publish false information or to intentionally mislead by information;
  7. to publish or transmit computer viruses or any type of malicious code that could affect the functionalities or operations of the Platform or of the partner sites and / or under the Veruvis umbrella;
  8. collect or monitor the personal information of others;
  9. to deceive, to act in a virtual crime using various internationally prohibited methods;
  10. for any obscene or immoral purposes;
  11. to attack the security systems of the Platform or of the partner sites or under the Veruvis umbrella.

We reserve the right to stop without hesitation your access to the services of the Platform or the services of the partner sites or under the umbrella of Veruvis for violating any prohibition mentioned in the Terms and Conditions.

Chapter XV. Disclaimer of warranties

By using the content, the user expressly and unequivocally accepts the terms and conditions of the site, in the latest updated version, which is communicated on the site, existing at the time of navigation on the site or when we interact with us through site forms or contact details.

We reserve the right at any time to modify or discontinue certain or more services (or any part or content of our site) without notice. We will not be liable to you or any third party for any changes to, suspension or termination of certain or more services.

Chapter XVI. End of Responsibilities of the Parties

The responsibilities and obligations of the contracting parties under these Terms and Conditions will remain applicable until such time as the contractual relationship is concluded by either party. You may terminate your compliance with the Terms and Conditions at any time by stopping accessing our site.

If, in our judgment, we believe that you have violated or suspect that you have violated one or more provisions, we reserve the right to suspend or terminate your access to our website without notice to you,  remaining liable for damages or liabilities acquired while using our website.

Chapter XVII. Conflict resolution. Applicable law

Any attempt to gain unauthorized access to the site and any attempt at fraud will be reported to the competent authorities. Any conflict between Veruvis and Users is tried to be resolved amicably, by agreement between the two parties.

If this is not possible, the Romanian legal provisions in the field will be applied, and the settlement of disputes is within the competence of the Romanian courts.

We invite you to communicate to dpo@veruvis.com any complaints you may have about our site and services in order to resolve the situation as quickly as possible.

Chapter XVIII. Final Provisions

If any of the above clauses is found to be void or invalid, this will not affect the validity of the other clauses.
